Registration and regulation of Thailand's community radio stations

Registration

began this week in Thailand. Compared to other countries, Thailand has long been a veritable wild west of locally-run radio stations:
There
are more than 5,000 community radio stations in the country
and all are broadcasting without licences, said Col Natee Sukolrat,
chairman of the NTC's
working group on community radio.
The stations fall into three categories: public service, community services, and for business. Col Natee said stations for business were in the majority.
He said revised regulations of the Telecom Business Act empowered the NTC to appoint a subcommittee to issue licences to Type 2 or community service stations first. Other types were asked to register and operate on a trial basis while awaiting licences. (Source: Bangkok Post, 29-04-09 , link)

After this year's Black Songkran the government ordered the closure of several community radio stations as well as the red-shirt DStation satellite TV channel.
Politically incendiary statements have been a frequent occurence on both DStation, broadcaster for the red-shirt pro-Thaksin United Front for Democracy (UDD), as well as the yellow-shirt ASTV satellite TV.
In the future if either red-shirt or yellow-shirt media outlets are "judged to have incendiary content, they would be taken off the air. The same would hold true for all community radio stations" (From article).
Many will find this new regulation of the airwaves objectionable. As a recent Bangkok Post editorial argues the constitution "guarantees full press freedom and forbids prior censorship of any kind":
The
NTC was charged by the 1997 Constitution to return the public
airwaves to the public. Now, the commission proposes to place a whole
new set of public broadcasters under its control, including monitoring
and censoring the broadcasts themselves.
Technical regulations are necessary so that community radio stations can broadcast on limited frequencies, and not interfere with neighbours in the province or on the assigned frequency. No special regulations are needed by the NTC to govern content, and none should be given.

To put the recent move to regulate radio stations in perspective, imagine if someone in the US or Europe suddenly decided to buy a radio transmitter and start broadcasting out of their home. Regulators would soon arrive and quickly shut down the so-called "pirate radio station".
In fact regulation of radio stations has been in the works for a long time.

More than 1,000 community radio broadcasters registered to operate in an hour at the Impact Muang Thong Thani exhibition hall yesterday, when the National Telecommunications Commission opened its registry for the first time.
Prapaphan Boonsalee, a young DJ, hosts a community radio programme broadcast in Pathomsakorn community in Samut Sakhon.
It is expected that a thousand more community broadcasters will have registered when the commission's deadline ends in a month.
NTC's chairman of the working panel on community radio, Col Natee Sukolrat, said more than 2,000 community radio operators attended yesterday's briefing on community radio regulations and licensing.
The NTC is to hold similar briefings in Chiang Mai on June 22, Khon Kaen on June 29 and Songkhla on July 2.
The NTC requires broadcasters register to legalise their operations.
Once registered, they would be allowed to hold trial broadcasts for 300 days when the community radio station regulation becomes effective early next month. The local stations can sell advertising during those initial 300 days.
However, he warned that any community radio stations failing to register by the deadline could face legal action for illegal broadcasting.
To maintain a licence, broadcasters must comply with community radio regulations and be non-profit and without advertisements.
Col Natee said he expected the existing 5,000 community radio stations operating without a licence would dwindle to only a handful for public service and business purposes.
