presence, parliament
actually got a lot of work done yesterday.The Frequency Allocation Bill, an important bill needed before 3G mobile phone service can get fully underway in Thailand, was approved by parliament yesterday.

The House of Representatives yesterday approved the long-delayed Frequency Allocation Bill despite rising political tensions outside Parliament.
The bill, which calls for the creation of a single telecommunications and broadcasting regulator, was unopposed winning 245 votes.

The proposed legislation would amend the Frequency Allocation Law, which was mandated by the 1997 Constitution and has been in effect since 2000.
The vote was hailed as a positive sign for the telecom industry, which hopes a long-delayed auction for 3G mobile broadband licences might now go ahead.

House Speaker Chai Chidchob chaired the meeting yesterday, attended by just 263 out of 475 MPs. Only two MPs from the opposition Puea Thai party attended while the rest boycotted the sitting. One MP abstained from voting after two hours of debate and 17 declined to cast ballots.

The bill will now go to the Senate for scrutiny, using the same three-step process followed by the House: accepting the bill for debate, debating, and approving.
Senator Anant Worathitipong said passage by the lower house was a good sign, and that Senators would begin their process by April 5 at the earliest.
If the Senate approves the bill, it will become law. If they reject the bill, it would be returned to the House, and a joint committee of MPs and senators would scrutinise it.

The current parliamentary session ends in May and it is not clear whether the bill can pass all of the remaining steps by that time.
The current bill fixes the number of National Broadcasting and Telecommunications Commission (NBTC) members at 11 but Mr Anant said the Senate might increase it to 13 or 15. It also requires that half of the members come from applications and half from appointments.
The Senate might favour a selection method for all NBTC members, the same as for the current National Telecommunications Commission (NTC), said Mr Anant.

Telecom expert Anuparb Thiralarp said the new law, if passed, should help address loopholes in existing telecom regulations.
He cited the 3G licence auction as a prime example, noting that the current NTC has been unwilling to proceed because of questions about its legal authority.
With a single regulator for both telecoms and broadcasting, licensing would be faster and easier, he said

Broadcasting involved even more vested interests than telecommunications and this would be a barrier to solving problems, said Mr Anuparb.
A National Broadcasting Commission, called for under the 1997 charter, was never formed because of years of political sparring over claims of vested interests and conflicts of interest among prospective nominees.
Advanced Info Service chief executive Wichian Mektrakarn said the passage of the new bill was encouraging, but that its trip through Senate could still be time-consuming.

Jirathiti Rochananond, general manager of Next Step Co, a TV programme producer, called the bill a milestone for which the broadcasting industry had waited 12 years.
I hope to see fairness in allocating frequencies once the law takes effect and the single regulatory body is established. But I'm still worried that implementation may not be as transparent as it should be," he said.
Small players are still concerned that big companies will send their representatives or proxies to become members of the regulator.
However, Mr Jirathiti said fair frequency allocation would lead to higher quality of content as producers who want to secure frequencies must prove themselves to consumers.
